Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Provence Jewelry ("Provence", "we", "us", "our"), a jewelry manufacturer and retailer headquartered in Wuzhou, Guangxi, China. These Terms apply to all visitors, users, and purchasers of our website and services.

If you do not agree to these Terms, you must stop using our website and services immediately. Use of the website after changes to these Terms are posted constitutes your acceptance of those changes.

Changes to Terms

Provence Jewelry reserves the right to revise, amend, or add to these Terms at any time, at our sole discretion. Changes become effective immediately upon posting on the website. We encourage you to review this page periodically. Continued use of our site or services following any update constitutes your acceptance of the revised Terms.

Products & Customisation

Provence Jewelry offers two categories of products:

  • Ready-to-Order Designs — existing designs available on our website, crafted to your chosen specifications (metal, stone, size).
  • Fully Custom Designs — bespoke pieces created from your concept, sketch, or reference image. Custom orders require additional design consultation time and may carry additional fees.

All jewelry is handcrafted in our workshop in Mainland China using ethically sourced materials, including moissanite, lab-grown diamonds, natural gemstones, and precious metals (S925 sterling silver, 10K, 14K, 18K solid gold in yellow, white, and rose, and platinum). All metals are nickel-free and hypoallergenic.

Product photography is illustrative. Due to differences in monitor calibration, actual colors and proportions may vary slightly from images displayed on our website. Provence Jewelry is not responsible for these natural variations.

Gemstone tolerances: In compliance with industry standards, carat total weight may vary ±0.05 ct from the stated weight. For gemstone and pearl measurements, a tolerance of ±0.25 mm is allowed.

Provence Jewelry retains the right to use any custom or standard jewelry designs for marketing, portfolio, or commercial purposes, unless you specifically request otherwise in writing prior to placing your order.

Pricing & Payment

All prices on our website are listed in US Dollars (USD) unless stated otherwise. Prices are subject to change without notice. We strive to display accurate pricing at all times; however, typographical or system errors may occasionally result in incorrect prices being shown.

In the event of a pricing error:

  • We reserve the right to correct the error and contact you before processing your order.
  • If your order has already been shipped, you agree to either return the product or pay the difference between the charged and actual prices.
  • All listed prices are non-negotiable and final.

By submitting your order, you authorise Provence Jewelry and its payment processors to charge the full order amount to your selected payment method. Accepted payment methods are detailed at checkout. Orders are not confirmed until payment is successfully processed.

For custom orders, a deposit may be required before production begins. Deposit amounts and refund eligibility will be communicated during the consultation process.

Order Confirmation & Cancellation

Receipt of an order confirmation email indicates that your order request has been received — it does not constitute acceptance of the order by Provence Jewelry. Your order is accepted only when we have processed and approved it at our workshop.

Provence Jewelry reserves the right to cancel or refuse any order at any time for any reason, including but not limited to product unavailability, pricing errors, or suspected fraud. In such cases, any payment collected will be fully refunded.

Customer-initiated cancellations:

  • Standard orders may be cancelled within 24 hours of placement, provided production has not yet begun.
  • Custom orders that have entered the design or production phase are not eligible for cancellation. Deposits on such orders are non-refundable unless Provence Jewelry is unable to fulfil the order.

Shipping & Delivery

Provence Jewelry ships worldwide via FedEx or DHL. Free shipping is available on qualifying orders; please refer to our Shipping Policy for current thresholds and exclusions (special offers, group buys, and custom orders may be excluded).

All shipments are fully insured against loss, theft, or damage in transit. Title and risk of loss transfer to the customer upon delivery to the shipping address provided.

Estimated delivery times vary by destination and are provided at checkout. Provence Jewelry is not liable for delays caused by customs clearance, carrier disruptions, natural events, or circumstances outside our control. Customers are responsible for any applicable import duties, taxes, or customs fees imposed by their country.

Please ensure your shipping address is accurate. Provence Jewelry cannot be held responsible for delivery failures due to incorrect or incomplete addresses provided by the customer.

Returns & Exchanges

We stand behind every piece we craft. Provence Jewelry offers a 90-day return and exchange policy for qualifying purchases.

You are eligible for a full return or exchange if:

  • The item has a manufacturing defect or quality issue.
  • The item does not match the specifications confirmed in your order.

In these cases, Provence Jewelry will cover all return shipping costs and provide either a full refund or a replacement at no additional charge.

Please note: Fully custom-designed pieces are generally not eligible for return or exchange unless there is a verifiable manufacturing defect or a failure to match the agreed specifications. Size exchanges may be subject to a re-crafting fee.

To initiate a return or exchange, please contact our customer service team via WhatsApp or email within the 90-day window. Items must be returned in their original condition and packaging.

Provence Jewelry does not permit comparison purchasing — the practice of ordering multiple items with the intent to keep one and return the rest. We reserve the right to decline returns suspected of falling under this practice.

Warranty

All Provence Jewelry pieces are covered by a 90-day manufacturing warranty from the date of delivery. This warranty covers defects in materials and workmanship arising under normal use.

The warranty does not cover:

  • Damage resulting from accidents, misuse, or neglect.
  • Normal wear and tear, scratches, or tarnishing over time.
  • Unauthorised modifications or repairs carried out by a third party.
  • Lost or stolen items.

To make a warranty claim, please contact our support team with your order number and photographs of the issue. Warranty repairs or replacements are provided at no cost to the customer during the covered period.

Gemstone Certificates

Certificates (GRC or NGIC) are available for finished jewelry pieces upon request for an additional fee. Please contact our support team before or after purchase to arrange certification.

Where a diamond grading report accompanies a purchase, this report must be included with any returned item. Failure to include the original certificate will result in a replacement fee being charged to the customer.

Intellectual Property

All content on provencejewellery.com — including but not limited to text, photography, product designs, logos, graphics, and the overall "look and feel" of the website — is the proprietary property of Provence Jewelry or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on this site without the prior written permission of Provence Jewelry. Unauthorised use may violate copyright, trademark, and other applicable laws.

The Provence Jewelry name, logos, and associated marks may not be used without our express written consent.

Use of the Site

You are granted a personal, limited, non-transferable licence to access and use this website for lawful, non-commercial, personal purposes. This licence does not permit:

  • Any resale or commercial use of the site or its content.
  • Collection of product listings, images, or descriptions for commercial use.
  • Use of automated tools such as scrapers, robots, or data extraction software.
  • Any action that interferes with the normal operation of the site.
  • Attempts to gain unauthorised access to any part of the site or its systems.

Provence Jewelry reserves the right to suspend or terminate access to the site at any time, without notice, for any violation of these Terms or applicable law.

User Content & Reviews

Where our website allows you to submit reviews, comments, or other content, you agree that any material you submit is accurate, non-deceptive, and does not infringe the rights of any third party.

By submitting content, you grant Provence Jewelry a non-exclusive, royalty-free, perpetual, and worldwide licence to use, reproduce, and display that content in connection with our business and marketing activities.

You must not submit content that is unlawful, defamatory, obscene, threatening, or otherwise objectionable. Provence Jewelry reserves the right to remove any user content at its sole discretion and without prior notice.

PROVENCE JEWELRY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SITE OR THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION CONTAINED HEREIN. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVENCE JEWELRY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVENCE JEWELRY, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE OR PURCHASE OF OUR PRODUCTS. IN NO EVENT SHALL PROVENCE JEWELRY'S TOTAL LIABILITY TO YOU EXCEED THE PRICE PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Provence Jewelry, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your use of our website; your breach of these Terms; any content you submit or transmit; or your violation of any applicable law or the rights of a third party.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict-of-law principles. Any dispute arising under or in connection with these Terms shall first be submitted to good-faith negotiation between the parties.

If a dispute cannot be resolved amicably within 30 days, it shall be submitted to binding arbitration in Wuzhou, Guangxi, China. Nothing in this clause prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or proprietary information.

Customers residing in jurisdictions with mandatory consumer protection rights retain those rights notwithstanding the above.
